Legal Obligations of Websites

Does anyone know the rule: under which legal jurisdiction does a website operate ? Under the nationality of site location or of the administrator ? Or can admin say "my obligations end with warning the posters they exceeded the legal limits" ?

I believe that the geographical location of the server hosting the site defines the jurisdiction.

Well, whatever. Should we have some form of statement on our beloved website stating that the law in force at the website location applies and people transgressing this law* will be banned ?

* For example, turning their noses up at a nice roasted witchetty grub will cause loss of their posting rights.

Quite honestly, OFSO, that should not be necessary. I cannot believe that the 'transgressors' were not aware of the potential implications of the posts.

As for legal obligations. There is a legal term that has relevance - "Beneficial Owner". Which relates to someone who gains a benefit. Thus for a UK resident/business entity running an e-commerce site that is hosted in the US, UK legislation would apply. Things like the Trade Practices Act, guarantees and warranties, unconscionable conduct, etc.

I believe that this also applies to things like Domain Name registrations. You can register the domain name, host the site in the US, even pay through Pay-Pal, but if a UK entity gains the benefit then UK legislation can be shown to apply to any transactions negotiated through the site.

Suspect that publishing, say defamatory articles, on a web site would come under some publishing liability legislation. As would inciting racial or religious hatred via a forum. Authorities getting quite uppity these days with social media sites, holding the site beneficial owner liable for any transgressions.

Sorry folks, but just re-banned Airborne Aircrew for another month. First posting back he chose to reopen all the previous crap about bombing mosques, etc.. Demanding explanations for all the why's and wherefore's for him being banned. I really don't need all his drama and rubbish in my life. Three strikes and he's out for ever.

He did comment that he had been away camping, and was now going away for another two weeks. Which most probably fits his MO as an ex-rock ape. Throw a grenade through the window and then piss off before it explodes.

This is interesting from the news today, I am always surprised at the postings on Arrse, only a matter of time before it hit the fan, in this case from the raggle taggle Gypsy's that make our lives so colourful.

In one of several transcripts seen by i, one user posting under an anonymous pseudonym refers to them as “filthy, thieving, raping, parasitic scum”. Gypsies and Travellers are classed as an ethnic minority in the UK and are protected by equality legislation, making discrimination against them illegal.
Another user wrote: “Speaking, as I do, for all members of the military community, can I just say that if I was in a unit that contained pikeys I’d kill them.” Further down the same thread, a second person replied: “Personally I would rather rip the skin of [sic] the f****** and roll them in salt before burning them.”
One forum user also referred to “thieving gyppo c****”, adding: “They should all be rounded up into one big field, with all their caravans, then they should be cleansed with fire.” Another comment read: “I have met good Muslims but never a good Pikey.”

Racism laws only applies to White people.

In Oz, Aboriginies are generally more racist than Whites, both towards other cultures
and even more so within their own society.
