NY attorney general has been looking into the taxes of Trump Organization CFO for months, sources say

https://www.cnn.com/2021/05/19/politics ... index.html

(CNN)The New York attorney general's office has opened a criminal tax investigation into top Trump Organization officer Allen Weisselberg, increasing the legal pressure on the long-time aide to former President Donald Trump, people familiar with the investigation say.

The pressure on Weisselberg is mounting from two directions with the attorney general looking into his personal taxes, while prosecutors in the district attorney's office are digging into his role at the Trump Organization, his personal finances, and benefits given to his son Barry, a long-time employee of the Trump Organization.

Prosecutors are seeking to find leverage that could sway Weisselberg into cooperating with authorities, people familiar with the investigation said, potentially raising the legal stakes for Trump and his family. It's a common tactic used by prosecutors to try to get individuals to "flip" to help build a case higher up the corporate ladder. Vance's office is coordinating with James' office on its criminal investigation into Weisselberg.
Weisselberg has not been accused of any wrongdoing.
The tax investigation into Weisselberg's personal finances by New York attorney general Letitia James was opened several months ago and is being handled by a small unit within the office that has authority to bring criminal charges, people familiar with the investigation said.
Those investigators have been coordinating with prosecutors in the Manhattan district attorney's office led by Cyrus Vance Jr, which has been investigating the Trump Organization, going through Trump's tax returns, and recently has been examining perks the company gave to employees, Weisselberg's finances, and benefits he and his son received, people familiar with the inquiry said.

On Tuesday, the attorney general's office said it was also joining the district attorney's office's criminal investigation into the Trump Organization and has informed the company that its investigation is no longer solely civil in nature.
The attorney general's office tax investigation is focusing on Weisselberg as an individual, but it could expand to include actions he has taken in his role at the Trump Organization, the people said.
Weisselberg, who has handled the Trump Organization's finances for 40 years, including as its chief financial officer, recently beefed up his legal team, adding Bryan Skarlatos, a prominent tax specialist and criminal defense lawyer, people familiar with the arrangement say. Skarlatos is working with Mary Mulligan, a criminal defense attorney who has represented Allen Weisselberg for several years. Skarlatos and Mulligan declined to comment.

Details of the scope of the New York attorney general's investigation have not been previously reported. The Washington Post first reported that a lawyer assigned to James' criminal unit was the point of contact for Weisselberg's former daughter-in-law Jennifer Weisselberg, who has been cooperating with investigators.
One theory prosecutors are exploring is whether there was a practice at the Trump Organization to dole out benefits to employees instead of salaried compensation to lower its payroll taxes, people familiar with the investigation said.
Recently, prosecutors have started looking into rent payments on Weisselberg's Manhattan apartment, the people said.
On Wednesday, Trump responded to the James teaming up with Vance's office by calling the investigation a "political and partisan Witch Hunt" and an "investigation...in search of a crime." Lawyers for the Trump Organization declined to comment.
Even before they teamed up the Vance and James investigations have been underway for more than two years and are looking at, among other things, whether the company improperly inflated the value of assets to its properties to obtain favorable terms for loans, insurance coverage and tax benefits, while also deflating the value of reduce real estate taxes.

Investigators are also exploring whether the Trump Organization committed tax fraud involving its Seven Springs estate in New York as well as its handling of hush money payments made to Stormy Daniels to silence her alleged affair with Trump, which he denies.
Documents shared by former daughter-in-law
The attorney general's criminal investigation into Weisselberg's personal finances began, in part, because of documents shared by his former daughter-in-law Jennifer Weisselberg, one person told CNN. She told CNN in March that she has been speaking with prosecutors from James' office since September.
Her attorney Duncan Levin previously told CNN that she has 25 years-worth of bank records, credit card records and tax records in her possession. Weisselberg has also met with the district attorney's office multiple times and was subpoenaed for documents.
Jennifer Weisselberg was married for 14 years to Barry Weisselberg, who for two decades managed Trump Organization businesses contracted out by New York City in Central Park, including Wollman Rink and Lasker Rink. It is not clear if he is still employed by the Trump Organization.
The lavish lifestyle that Jennifer and Barry Weisselberg lived during their 14 years of marriage was largely funded by Allen Weisselberg, Barry Weisselberg testified during a 2018 divorce deposition obtained by CNN.
Documents from Jennifer and Barry Weisselberg's divorce show thousands of dollars of payments for cars, rent, tuition, medical bills and more coming from Allen Weisselberg to his son's family.

The spending and benefits are what has attracted scrutiny by prosecutors in both offices. The district attorney has questioned Jennifer Weisselberg about benefits she received during her marriage, including access to Trump-owned rent-free apartments, she previously told CNN. More recently, their interest has turned to questions around tuition payments for her children.
Barry Weisselberg said in the August 2018 deposition that was taken as part of the divorce proceedings, his father paid for their children's school tuition at Manhattan private school Columbia Grammar & Preparatory school, which currently run about $54,000 annually per child, according to the school's website.
"My father feels that if it's involving the children that he would like to contribute as much as he can for his grandkids, whether it's camp, whether it's school," Barry testified in 2018.
Barry Weisselberg testified that he believed those payments from his father were "financial assistance" and not loans. A statement of net worth for Barry Weisselberg filed in 2020 as part of a continuation of the couple's divorce proceedings said that Barry's parents paid for the children's tuition and that, "absent this financial assistance, (he) could not afford private school."
Those tuition payments are an area authorities are now scrutinizing, according to people familiar with the investigation. Columbia Grammar & Preparatory school, which Trump's youngest son Barron attended, was also attended by Weisselberg's grandchildren, according to people familiar with the matter. The Wall Street Journal first reported that the district attorney's office subpoenaed the school for information about tuition payments.
Frank Perrone Jr., an attorney for Columbia Grammar & Preparatory School previously told CNN the school would not comment on issues involving students, their families or alumni, but that it would "comply with lawful requests from the authorities."

Direct payments for someone else's tuition from a person to a school would, in themselves, not raise red flags for tax law violations, said Laura Cunningham, a Cardozo Law professor specializing in tax law. While annual limits for how much one person can gift another person are currently capped at $15,000, direct payments for tuition and medical bills are exempt from this, she said.
But Cunningham said it's a different story if the tuition or medical payments are coming from someone's employer.
In April, Jennifer Weisselberg told CNN she believes that at least some of her two children's tuition payments were paid for by Donald Trump saying Trump paid for one child and Allen paid for the other.
"I know for a fact Donald wrote those checks," she told CNN in April.
Levin, Jennifer Weisselberg's attorney, told CNN that she would not comment further on matters related to her children at this time.
"Jen Weisselberg has plenty to say on this subject, but she will continue to provide that and other information to relevant authorities including the Manhattan District Attorney's Office," he said.
When asked during the 2018 deposition if Donald Trump personally paid for any household or personal expenses during his marriage, Barry Weisselberg said, "I don't know."

Anyone want to make book on whether Weisselberg or Giuliani flip? Also, if both do, which one will be first? :-?

New York attorney general adds 'criminal capacity' to probe of Trump Organization

https://www.cnn.com/2021/05/18/politics ... index.html

(CNN)New York Attorney General Letitia James is joining the Manhattan district attorney's office in a criminal investigation of the Trump Organization, James' office said Tuesday.

The attorney general office's investigation into the Trump Organization, which has been underway since 2019, will also continue as a civil probe, but the office recently informed Trump Organization officials of the criminal component.
"We have informed the Trump Organization that our investigation into the organization is no longer purely civil in nature. We are now actively investigating the Trump Organization in a criminal capacity, along with the Manhattan DA," James' spokesman Fabien Levy told CNN. "We have no additional comment."
In an increasingly serious sign for former President Donald Trump, the attorney general's office is working with the Manhattan district attorney's office, whose wide-sweeping probe into the Trump Organization has looked into whether the company misled lenders and insurance companies about the value of properties and whether it paid the appropriate taxes. James' notification to the organization brings a new level of potential legal risk to the former President, with the attorney general now able to seek criminal penalties as part of the probe.
Trump on Wednesday blasted the criminal probe of his company as "corrupt."
"There is nothing more corrupt than an investigation that is in desperate search of a crime. But, make no mistake, that is exactly what is happening here," he said in a lengthy statement.
The former president accused James of leaking information about the scope of her investigation to the media and ignoring "real issues" related to crime in New York City. In his statement, Trump attempted to cast the investigation as tainted from its outset -- claiming that James "swore that she would 'definitely sue' me."
A lawyer for the Trump Organization had previously declined to comment when reached by CNN.
Manhattan District Attorney Cy Vance's office is examining millions of pages of documents that include Trump's tax returns.
A person familiar with the investigation said a couple of investigators with the New York attorney general's office, who are steeped in knowledge about the Trump Organization, have joined the district attorney's team. A different person familiar with the matter said the New York attorney general is still conducting a civil investigation.
Trump has previously called the New York attorney general's investigation politically motivated.
For the past two years, James' office looked into matters including whether or not it improperly inflated assets on financial statements to secure loans and obtain economic and tax benefits, as well as how Trump Organization employees were compensated.
Trump's former attorney Michael Cohen testified before Congress in 2019 that Trump's annual financial statements inflated the value of his assets to secure favorable loans and insurance coverage, but deflated the value of other assets to reduce real estate taxes.
Investigators have deposed multiple Trump Organization officials including Eric Trump, the former President's son, and Chief Financial Officer Allen Weisselberg.
Trump's longtime tax attorney Sheri Dillon was also deposed but the state says she declined to answer certain questions.
Several Trump Organization properties' financial dealings are being scrutinized as part of the investigation, including Seven Springs Estate in Westchester County, New York; 40 Wall Street, a building in Lower Manhattan; Trump International Hotel and Tower Chicago; and Trump National Golf Club in Los Angeles.

From Woody's quote
At the heart of this.... is the very American notion of a God-given right to do one's own thing,
Is that the core issue then?

Don't worry.
This is just a warm-up for next weekend (Memorial Day holiday) PT.1

Gunfire erupted in a New Jersey home packed with hundreds of guests. A man and a woman were killed, and dozens were shot.

https://www.cnn.com/2021/05/23/us/new-j ... index.html

(CNN)A house party packed with hundreds of guests devolved into chaos when gunfire erupted, killing at least two people and wounding a dozen more.

A man and a woman were shot and killed at the house party in Cumberland County, New Jersey State Police said.
At least 12 more people were shot in the melee on East Commerce Street in Fairfield Township around 11:50 p.m. Saturday.
Cooper University Hospital in Camden said it received six victims from a shooting at a home in Cumberland County.
It's not clear how many victims in total were taken from the scene to area hospitals.

"No arrests have been made, and the motive and incident remain under investigation," New Jersey State Police posted on Facebook.
"Anyone with information is asked to contact the New Jersey State Police Bridgeton Station at 856-451-0101 . Anonymous tips are welcome."
New Jersey Gov. Phil Murphy urged the public to help law enforcement with any information.
"Since late last night, the New Jersey State Police and county and local law enforcement in Cumberland County have been investigating the horrific mass shooting at a large house party in Fairfield Township that attracted hundreds of party-goers," Murphy said in a statement Sunday.
"At this time, at least two people have lost their lives, among numerous other shooting victims, including several with injuries that are life-threatening. We hold those who have died, and their families, in our prayers today, and we also pray for the recoveries of those injured. We are grateful for the swift response of law enforcement and stand with them as they continue their investigation," he said.

"Let there be no mistake: This despicable and cowardly act of gun violence only steels our commitment to ensuring New Jersey leads the nation in passing and enforcing strong and commonsense gun safety laws. No community should ever experience what occurred last night in Fairfield."
Across the street from the house, the Rev. Michael Keene, of Trinity AME Church, said he initially thought fireworks were going off.
"I just started hearing at first what I thought was fireworks, it was really gunshots, and I heard nine in rapid succession," Keene told CNN affiliate WPVI.
"If you're going to a party, why do you need to take a gun?" he asked. "If you're there to have a good time why do you need a gun with you? That means you're expecting trouble to me."

Shooting at unauthorized concert in North Charleston leaves 14-year-old dead and 14 others wounded

https://www.cnn.com/2021/05/23/us/north ... index.html

(CNN)A shooting at an unauthorized concert in North Charleston, South Carolina, late Saturday night left a 14-year-old dead and 14 others wounded, police said.

Officers responded to the area of Piggly Wiggly Drive and West Jimtown Drive in reference to a shooting at about 10:30 p.m. Saturday and found numerous victims with gunshot wounds, North Charleston Police Deputy Chief Scott Deckard said.
The victims were treated and taken to local hospitals. Several additional victims were located at area hospitals after being transported by others. Information on their status was not immediately available.
Deckard said a fight broke out near the concert stage prior to the shooting. As yet there is no information on a possible suspect or suspects.

Images of the scene taken by police and provided by CNN affiliate WCSC show a makeshift "tiki bar," coolers and drinks scattered across the area, a stage with large speakers and a table with food, sodas and snacks. The North Charleston Police Department said it was not aware of the event beforehand.
The incident was among several in another spate of weekend gun violence, including mass shootings in New Jersey, in Youngstown, Ohio, and Columbus, Ohio. American cities have seen a stark rise in gun violence over the last year that criminologists have connected to the coronavirus pandemic's economic and social impact as well as mistrust in policing.

Three found shot to death in Atlanta-area condo

https://www.cnn.com/2021/05/23/us/south ... index.html

(CNN)Police discovered three people shot to death early Sunday morning after they responded to a call of shots fired at an Atlanta-area condominium.

According to South Fulton Police spokesperson Jubal Rogers, the shooting happened in the 600 building of Camelot Condominiums, south of the city of Atlanta.
Officers responded to the shots fired call at about 1:30 a.m local time, and found three victims who had suffered gunshot wounds, Rogers said. All three were pronounced dead at the scene.
The investigation remains ongoing, and police have not released any information on potential suspects or a possible motive.

Two killed and eight injured in shooting in downtown Minneapolis

https://www.cnn.com/2021/05/22/us/minne ... index.html

(CNN)Two men were killed and eight other people were injured in a shooting early Saturday in downtown Minneapolis, police said.

Seven of the victims were taken to hospitals with non-life-threatening injuries and one man was in critical condition, according to the Minneapolis Police Department (MPD).
Jawan Contrail Carroll, 23, was arrested in Bloomington, Minnesota, on probable cause of murder and taken to the Hennepin County Jail, MPD spokesperson John Elder told CNN Saturday evening.
Jail records did not list an attorney for Carroll, and he had not been formally charged as of Saturday evening.
"He is the only suspect," Elder said.
Elder said police believe the other shooter was one of the two men killed.
A verbal confrontation likely led to the shooting, police said.
Two people standing in a crowded area on North First Avenue argued, pulled out guns and began shooting at each other, police said.
Officers working "evening bar close" at around 2 a.m. heard the gunshots and ran toward the gunfire, police said. They arrived at an "exceptionally chaotic scene" where two men had already died from their injuries.
"These brazen senseless acts of gun violence must stop. The perpetrators of these crimes should never find refuge or anonymity in our communities," Minneapolis Police Chief Medaria Arradondo said in a written statement Saturday.
Police are reviewing surveillance footage and interviewing witnesses, Elder said.
Of the 10 adults shot, five were male and five female, according to police.
The names of the victims as well as the nature and cause of death will be released by the medical examiner in the coming days, police said in a statement.
One of the two people killed had been scheduled to graduate later that day from the University of St. Thomas in St. Paul, according to the school. The university identified the victim as Charlie Johnson, a mechanical engineering student.
"Our community is shocked and saddened by the news of Charlie's death. We grieve with his family and friends and pray for their comfort," university president Julie Sullivan said in a written statement. "On a day he and his family should have been celebrating his graduation from our School of Engineering, we are devastated by this loss."
The university says Johnson was remembered at the school's commencement ceremonies Saturday, and a family member accepted his diploma posthumously.

2,500 people showed up to a Huntington Beach party that devolved into violence and vandalism, police say

https://www.cnn.com/2021/05/23/us/hunti ... index.html

Los Angeles (CNN)A social media post telling people to show up to a party in Huntington Beach led to the unlawful assembly of more than 2,500 people, police said.

Police in the Southern California city said they knew about the post and made preparations, but the crowd became "unruly" Saturday night -- prompting the declaration of an unlawful assembly.
"The initial crowd at the beach grew in size and moved to the downtown area where it was estimated to be over 2,500," the Huntington Beach Police Department said in a statement.

"As the crowd size continued to grow rapidly, large groups disbursed into various locations throughout the area, throwing bottles, rocks, fireworks, and other items at officers. At that time, the HBPD requested assistance from outside agencies. Throughout the course of the evening, over 150 officers from virtually all agencies within Orange County were deployed to Huntington Beach based on the pre-arranged request for assistance."
Multiple downtown businesses, police vehicles and a lifeguard tower were damaged due to vandalism, authorities said.
An emergency curfew was issued from 11:30 p.m .Saturday until 5:30 a.m. Sunday for parts of Huntington Beach, police said.
By the time the chaos ended, 121 adults and 28 juveniles were arrested and booked for charges such as vandalism, the firing of dangerous/illegal fireworks, failure to disperse and curfew violations, police said.
No significant injuries have been reported.
Huntington Beach

Huntington Beach resident Natalie Rosso said it's not uncommon for a social media post to draw massive crowds to the coastal community, about 35 miles southeast of Los Angeles.
"When something goes viral in Huntington Beach it always brings the biggest crowds that are crazy," Natalie Rosso posted along with a video on Instagram.
"You can't even drive down the street now."
Afterward, Rosso told CNN she was "disappointed" by what happened.
She said she's lived in Huntington Beach her "whole life and have never seen anything like that before."

Recently someone ran amok with a knife in a supermarket and injured four people before being detained by members of the public.

https://www.odt.co.nz/news/dunedin/crim ... ing-attack

When I read this in the account of the event -
Another woman who was entering the supermarket at the time said she was confronted by two hysterical girls.

Another bystander grabbed them, thinking they were shoplifters but they were followed by a stampede of shoppers.

"It was chaos," she said. "Unbelievable."
- I was thankful there had not been a "good guy with a gun" leaping to conclusions.
And with the morn, those angel faces smile...

Hump Day Mass Shooting

Transit employees among 9 dead in shooting at San Jose rail yard

A public transit employee opened fire on co-workers at a Northern California rail yard Wednesday, killing more than a half-dozen people before taking his own life, authorities said.

Calls of shots fired came about 6:34 a.m. PT near 100 W. Younger Ave. in downtown San Jose, drawing a large law enforcement response, the Santa Clara County Sheriff's Office said.

The shooter was identified as Samuel Cassidy, an employee of the Santa Clara Valley Transportation Authority (VTA), law enforcement sources said. He shot and killed himself at the scene, according to sources.

At least eight people were killed, not including the shooter, sheriff's Deputy Russell Davis said.

"This is a horrific day for our city and it is a tragic day for the VTA family, and our heart pains for the families and the co-workers because we know so many are feeling deeply this loss of their loved ones and their friends," San Jose Mayor Sam Liccardo told reporters at the scene.

Santa Clara County Sheriff Laurie Smith said her deputies and San Jose police officers arrived quickly after the initial 911 calls.

“When the shots were still being fired, our teams, with San Jose PD, are entering the building while shots were still going off. We attempted rescues," Smith said. "We have some very brave officers and deputies."

Citing an "active shooter," deputies told the public at 7:12 a.m. PT to steer clear of the neighborhood, about 50 miles south of downtown San Francisco.

Even hours after the shooter died, a bomb squad was clearing the area in case he left explosives behind.

“We received information that there are explosive devices that are located inside the building,” Davis told reporters at the scene. “ We’re trying to clear out every room, every crevice of that building.”

The dead suspect is believed to be the only shooter involved, according to officials.

"Public safety is assured at this point," Davis said.

At about the same time gunfire erupted at the VTA yard, San Jose firefighters rushed to a home about 10 miles away that was engulfed by flames, officials said.

That home, near 1100 Angmar Ct., is the suspect's, law enforcement sources said. Investigators believe there was ammunition inside the home and firefighters smelled an accelerant when they arrived, sources said.

"We're trying to figure out, exactly, if there's a connection" between the fire and shooting, Davis said.

The Younger Avenue address is a light rail yard of the VTA, which provides bus, rail and various shuttle services to the booming Bay Area suburb and technology hub.

Davis called the shooting scene a VTA "control center" which is a "hub that stores multiple VTA trains and a maintenance yard as well."

The shooting happened "on the VTA light rail yard but it did not happen in the operations control center," VTA Board Chairman Glenn Hendricks said.

Hendricks added he was proud of transit workers who stayed on the job and kept moving commuters even in the face of Wednesday's mass shooting.

"A horrible tragedy has happened today," Hendricks said. “I could not be more proud of the VTA organization. As I drove here, I saw VTA buses out on the road."

The suspect was described as a "substation maintainer," law enforcement sources said. And state public employee records showed a VTA employee named Samuel Cassidy, with that same position, who made $114,426.17 in 2019 wages, the last data available.

The shooting scene is at the center of regional law enforcement operations, as the rail yard is within a half-mile of the San Jose Police Department, the Santa Clara County Sheriff's Office and District Attorney headquarters.

The shooting comes amid a yearlong rise in nationwide gun violence and record firearm sales.

White House principal deputy press secretary Karine Jean-Pierre said the federal government is keeping in close contact with law enforcement in San Jose.

"We will continue to stay in close contact with them and offer any assistance as needed," she said. "We still don't know all of the details ... but what's clear, as the president has said, is that we are suffering from an epidemic of gun violence in this country, both in mass shootings and in the lives that are being taken in daily gun violence that doesn't make national headlines."

We now know that Eisenhower over-ruled his military chiefs who wanted to nuke China.

It's scary that a weaker President such as Clinton or Obama or Biden might not have the balls to stand up against the war-crazed Generals of the Pentagon.

When one sees the present chain of command, it certainly is "Scary". Who since Eisenhower would have the "Balls" to stand up to the military chiefs. Do not expect an answer to that question, especially if Kamala ends up in the top seat.

There is a picture of POTUS in today's Telegraph saluting at Arlington. I suppose, as commander in chief, he is in order giving a military salute. The style of salute seems half way between a Naval eyeshade and an army flat palm toward the face.

It seems to be a 'bi-polar' choice - do we want the Chump telling the military what to do or possibly the military telling Biden what to do?
