A New York appellate court on Thursday suspended Rudy Giuliani's law license after finding he made "demonstrably false and misleading" statements about last year's election while serving as former President Donald Trump's attorney.

In a 33-page decision, the court panel wrote: "We conclude that there is uncontroverted evidence that respondent communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at reelection in 2020."

"These false statements were made to improperly bolster respondent’s narrative that due to widespread voter fraud, victory in the 2020 United States presidential election was stolen from his client," the ruling continued. "We conclude that respondent’s conduct immediately threatens the public interest and warrants interim suspension from the practice of law, pending further proceedings before the Attorney Grievance Committee."

Giuliani, a former U.S. Attorney and mayor of New York City, he can appeal the decision but can’t practice law at this time in New York. He did not immediately respond to requests for comments from NBC News. In a statement, his attorneys expressed disappointment with the ruling, which they said took place before Giuliani could present his case in a hearing.

"This is unprecedented as we believe that our client does not pose a present danger to the public interest," Giuliani attorneys John Leventhal and Barry Kamins said. "We believe that once the issues are fully explored at a hearing Mr. Giuliani will be reinstated as a valued member of the legal profession that he has served so well in his many capacities for so many years."

The panel examined several comments made by Giuliani and the defenses he offered of them to the court, and rejected Giuliani's argument that the investigation violated his First Amendment speech protections.

"This disciplinary proceeding concerns the professional restrictions imposed on respondent as an attorney to not knowingly misrepresent facts and make false statements in connection with his representation of a client," the decision sates. "It is long recognized that 'speech by an attorney is subject to greater regulation than speech by others.'"

The panel also reviewed false claims Giuliani made about the number of mail-in ballots requested in Pennsylvania. Giuliani's defense was that he did not know those assertions were false and that a member of his "team" had gotten incorrect data from the state's website.

But the court said: "There is simply no proof to support this explanation."

"For instance, there is no affidavit from this supposed team member who is not identified by name or otherwise, nor is there any copy of the web page that purportedly listed the allegedly incorrect data," the ruling said. "In fact, the only proof in this record is the official data on the Pennsylvania open data portal correctly listing the ballots requested as 3.08 million."

The panel also cited comments Giuliani made in a Pennsylvania court last year. During that appearance, Giuliani said: "I don’t know what’s more serious than being denied your right to vote in a democracy."

"We agree," the panel wrote. "It is the very reason why espousing false factual information to large segments of the public as a means of discrediting the rights of legitimate voters is so immediately harmful to it and warrants interim suspension from the practice of law."

Giuliani was at the forefront of Trump's efforts to overturn the election, traveling across the country to argue the spurious claims of fraud before state lawmakers, courts and the public. The former mayor of New York City, Giuliani is also a former U.S. attorney for the Southern District of New York.

In April, federal agents executed search warrants on Giuliani's Manhattan apartment and office to seize electronic devices as part of an investigation into his dealings in Ukraine.

After the Jan. 6 Capitol riot, the New York State Bar Association launched an inquiry into whether to remove Giuliani from its ranks.

New York state Sen. Brad Hoylman, a Democrat who filed the initial complaint, said he was happy with the ruling.

"The profession of law is a sacred and noble one," he said. "And there can be no room in the profession for those who seek to undermine and undo the rule of law as Rudy Giuliani has so flagrantly done.”

(CNN)In a carefully reasoned and evidence-packed decision, a New York State appellate court suspended Rudy Giuliani's law license this week. The court found that Giuliani engaged in so many clearly unethical actions while seeking to overthrow the results of the 2020 presidential election on behalf of his client Donald Trump, that immediate action was necessary to protect the public.

The order strips the former US Attorney and New York Mayor of his right to practice law while the court's Attorney Grievance Committee investigates misconduct claims against him. Giuliani can request a court hearing on the interim suspension within 20 days of the order.
The decision to suspend an attorney while he is still being investigated is highly unusual and customarily reserved for only the most serious forms of professional misconduct. But the court has made a compelling case that Giuliani's misconduct was a knowing and deliberate attempt by an officer of the court to disrupt and obstruct America's 2020 presidential election in violation of the legal profession's code of professional responsibility.
The number of allegedly false claims and acts of outright dishonesty outlined in the decision is truly staggering. Giuliani's career appears destined for ruination while Donald Trump heads for the golf course.

The punishment could include disbarment or a forced resignation when the proceedings conclude. Giuliani has hotly contested the validity of the charges as political. His lawyers said in a statement Thursday that "we believe that our client does not pose a present danger to the public interest. We believe that once the issues are fully explored at a hearing Mr. Giuliani will be reinstated as a valued member of the legal profession that he has served so well in his many capacities for so many years."
What do the charges say? They relate to extravagant and patently false claims of election fraud that he lodged in various courts and in other public forums on Trump's behalf. A particularly unusual aspect of the court's blistering 33-page decision was its reliance not only on allegedly false statements made by Giuliani in court and legislative proceedings, but also on statements he made in podcasts, on television and in other public but non-legal forums.
The court explicitly noted that the First Amendment does not give attorneys freedom to lie and commit harmful acts of fraud in connection with their representation of a client in any forum. The decision should be a stern reminder to attorneys running for public office that egregious lies and false statements that cause public harm, even in political campaigns, may warrant disbarment or other disciplinary sanctions.

Attorneys are customarily suspended immediately only for grossly improper actions that harm clients or undermine the integrity of the courts. Cases resulting in immediate suspensions often apply to attorneys who have substance abuse problems, serious criminal convictions or who steal clients' money.
The Giuliani decision is a reminder to the bar that a lawyer's responsibility to act with integrity and honesty extends beyond the courtroom to any situation where a "third person" may be influenced or harmed. The judges made it clear in that if Giuliani, acting as the President's personal lawyer, willfully used fraud and deceit to undermine the election, the repercussions would be severe.
"The seriousness of respondent's uncontroverted misconduct cannot be overstated," the court wrote. "Where, as here, the false statements are being made by respondent, acting with the authority of being an attorney, and using his large megaphone, the harm is magnified... One only has to look at the ongoing present public discord over the 2020 election, which erupted into violence, insurrection and death on January 6, 2021, at the U.S. Capitol, to understand the extent of the damage that can be done when the public is misled by false information about the elections. The AGC [Attorney Grievance Committee] contends that respondent's misconduct directly inflamed tensions that bubbled over into the events of January 6, 2021 in this nation's Capitol."
The decision is also an encyclopedic recitation of what the disciplinary committee variously described as manifest dishonesty and fraud perpetuated by Giuliani in not only those public appearances and podcasts in New York but also in lawsuits and other proceedings in Pennsylvania, Georgia, and Arizona.

Giuliani's misconduct in states other than New York falls within New York jurisdiction, the court states, because the former mayor was admitted to practice in those states upon the representation that he was a lawyer in good standing admitted to practice in New York under the "pro hac vice" (for this case only) doctrine.
The case against Giuliani reads in some respects like a criminal indictment with multiple counts. In a larger sense, anyone who wants to understand the completely fraudulent nature of the claims that the 2020 presidential election was "stolen" from Donald Trump need only read this very detailed opinion. (Click here.) It is an index of fraud, lies and professional misconduct designed to undermine American democracy, and used by many of Donald Trump's representatives, both in and out of court.
The really tragic aspect of the whole affair is that Rudolph Giuliani, the man often referred to as "America's Mayor" for the strength and guidance he provided to New York City in the aftermath of 9/11, will now find his professional destruction in a different pile of rubble. This one created by Donald Trump.

(CNN)The New York Police Department arrested an alleged gang member in a June 17 shooting in the Bronx that put two children in the line of gunfire, Chief of Detectives James Essig said at a news conference Friday.

Michael Lopez, 27, has ties to the "Make it Happen Boyz" gang and a long history of crimes involving guns and violence in New York City, Essig said.

With five prior arrests, Lopez is on parole until 2023 for a 2014 attempted murder charge. He has several open cases against him from 2020 alone.

Yes the US has a problem with guns. The problem is who has the guns.

He was arrested at his stepfather's residence in Harlem on Friday, Essig said.
Bronx County District Attorney Darcel Clark said Lopez was to be arraigned in court Friday on multiple charges, including attempted murder. If convicted, Lopez faces a maximum of 25 years in prison. The NYPD is still searching for another suspect who is seen riding a scooter in the video released by police.
CNN was unable to identify an attorney for Lopez Friday but reached out to The Legal Aid Society to see if an attorney there is representing him.

"More than 40 years ago during a Yankee game, the TV cameras focused on a building on fire not too far from Yankee Stadium and the announcer said, 'The Bronx is burning'," Clark said. "That footage defined the Bronx for years to come and we were seen as a place of destruction and arson."
"Now, we have this video of two innocent children running for their lives. The images of a 13-year-old girl shielding her 5-year-old brother from bullets fired by a gunman in broad daylight on a Thursday afternoon," Clark said. "That heart-wrenching video was seen around the world and now I fear that the catch-phrase is, 'The Bronx is bleeding.'"

The 24-year-old victim was taken to the hospital in stable condition. The children were not struck. An NYPD spokesperson told CNN Saturday the children are family members but are not related to the victim.
